Terms of Service

Last updated: June 2026 · Version 1.0.0

1. Agreement to Terms

By creating an account on AviationChat ("the Service"), operated by [LEGAL REVIEW: Replace with legal entity name — e.g., "AviationChat LLC"] ("the Company", "we", "us"), you ("you", "the User", "Student") agree to be bound by these Terms of Service. If you do not agree, do not create an account or use the Service.

You must be at least 16 years of age to use this Service. [LEGAL REVIEW: Confirm minimum age requirement and COPPA/state law implications for users under 18. Verify parental consent requirements if any.]

2. Description of Service

AviationChat is an AI-powered ground school oral preparation tool for student pilots. The Service uses multi-agent AI technology to provide personalized, Socratic-style tutoring aligned with FAA Airman Certification Standards (ACS).

⚠️ CRITICAL DISCLAIMER — NOT FLIGHT INSTRUCTION

AviationChat provides ground school oral preparation and knowledge review ONLY. It is NOT flight instruction, operational flight advice, or a substitute for instruction from a certified flight instructor (CFI). Do NOT rely on AviationChat content for any in-flight operational decisions. Always consult current FAA publications, a qualified CFI, and your aircraft's approved documentation for operational matters.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to update your information as necessary. You are responsible for all activity under your account.

4. Data Collection & Usage

By using the Service, you acknowledge and consent to the collection of:

  • Chat transcripts (text conversations with AI agents)
  • Voice transcripts (voice sessions with AI instructors)
  • Learning telemetry (mastery scores, quiz results, study patterns)
  • Profile information (name, email, certification goals)

This data is used to provide personalized tutoring, track your progress, and improve the Service. See our Privacy Policy for full details.

5. Data Licensing

By using the Service, you grant the Company a non-exclusive, worldwide, royalty-free license to use your anonymized and aggregated learning data (including interaction patterns, mastery progression, and response patterns) to improve the Service, develop educational research, and create derivative training materials.

[LEGAL REVIEW: Confirm scope of data licensing clause. Verify this covers Tier-3 data-licensing ambitions. Clarify whether individual (non-anonymized) data is ever licensed and under what terms.]

This license does not extend to your personal identifying information, which is governed by the Privacy Policy.

6. AI-Generated Content

The Service uses artificial intelligence to generate educational content. While we strive for accuracy aligned with current FAA regulations and publications, AI-generated content:

  • May contain inaccuracies or outdated information
  • Should be verified against current FAA publications (FAR/AIM, PHAK, AFH)
  • Is NOT a substitute for professional flight instruction
  • Should NOT be relied upon for operational flight decisions

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

[LEGAL REVIEW: Confirm limitation of liability language is sufficient for an educational AI product. Consider adding specific aviation liability disclaimers.]

8. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 7, and 9 survive termination.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the [LEGAL REVIEW: Confirm governing jurisdiction — e.g., "State of Texas"], without regard to its conflict of laws provisions.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the version number and "last updated" date. If you have an existing account, you will be asked to review and accept the updated Terms before continuing to use the Service. Continued use after acceptance constitutes agreement to the revised Terms.
